Building a house and builder is doing every outside the contract we signed can we sue?

we met with a builder to build us a house and we was going with the mortgage co he suggested which was a friend of his which we did go through her, but the mortgage lady tried to tell us we had to buy our rate of 4.7upfront for 1600.00, so we went to another bank and the builder got extremely angry at us for that because he have a signed contract with him and the house was a very inexpensive price that he is building for us and now that the house is up he is not doing anything that is in the contract we agreed on, he used a whole lot of damaged wood to build the house which a lot of it is split and many more things he is doing that is opposite of what we agreed on in our contract, and he is also using a fake non existing mortgage brokerage company with a non licensed listing agent on our contracts which is a co TREC contract (Texas real estate commission) we later found this out that the listing mortgage co does not exist and the listing real estate agent license expired over 2 years ago so he is doing everything wrong and using very cheap material on the house also come to find out he never turned in our earnest money we paid him to the title co he is holding the check so even after we found that out we went to title co and paid it ourselves and they got the execution signed contracts now at the title co and they cashed our check and it cleared our bank. so what is my rights and how can i sue this builder because of breech of contract?
